Davis Bacon and Prevailing Wage Considerations for Infrastructure Implementation

Many of the provisions in the Infrastructure Investment and Jobs Act (IIJA) require compliance with the Davis-Bacon Act, which requires that laborers employed on federal construction contracts be paid no less than the locally prevailing wages and fringe benefits for corresponding work on similar projects in the area. IIJA funding recipients, including State Energy Offices, will need to ensure compliance with this provision by ensuring that relevant clauses are inserted into sub-recipient contracts, providing guidance to sub-recipients, conducting monitoring, and reviewing and reporting information from payrolls.
